Exploring The Legal Process

Hello everyone! I'm Gael Phillips. It is nice to meet you. I'm here to talk to you about criminal laws, court proceedings and legal repercussions. I feel that sharing this knowledge is important, as many people do not realize how the legal process works. My first, and only, scrape with the law left me shaken. I did not know what to expect throughout the entire case, so I felt unprepared for the outcome. I hope to share my knowledge with people who are in need of support throughout the legal process. I will also post stories full of information about past legal cases for an idea about how the law works. The legal process doesn't need to be scary and mysterious. Sharing stories can give others the insight they need about their situation. Thanks for visiting, come back often!

Rejecting A Low Insurance Settlement Offer After A Collision

After an accident, the victim will usually try to obtain a settlement via the other party's insurance provider as soon as he or she can. What many accident victims are unaware of is that insurance companies are usually happy to offer a fast settlement, as it might be in their best interest. For example, if an accident victim is seriously injured in a collision, an insurance provider might quickly offer a low settlement before the victim decides to hire an attorney. If you are considering accepting an insurance settlement that you feel is too low in comparison to your injuries, the last thing that you should do is accept the settlement. You are better off hiring an attorney as soon as possible so he or she can take legal action to obtain a larger settlement.

Proving That You Deserve More Money

As long as there is sufficient evidence regarding your injuries and various aspects of your life that were affected by the collision, you can get more money than the initial settlement offer. The problem that most accident victims have without help from an attorney is proving that more money is deserved. For example, the victims might not know which type of evidence to gather. An attorney will investigate, gather medical records, find witnesses, and provide several other services to ensure that your evidence is solid. You will learn about things you can receive compensation for that you likely would not have known about without speaking to an attorney.

Expediting the Settlement Process

Just because an attorney will fight to get more money, it does not mean that your case cannot be settled fast. The great thing about an attorney is the extensive training that he or she underwent in law school and experience working in a specific branch of law. His or her legal expertise helps with working fast to obtain fair settlements for clients, such as via the power of negotiation. It is common for an attorney to first try to negotiate the initial settlement offer and avoid going to court. The negotiating process will usually involve one or more mediation sessions with the other party in an attempt to come to a mutual agreement.

Refusing to Settle for Less Than Deserved

Unfortunately, going to court is sometimes necessary when an attorney is not willing to back down on what he or she feels a client deserves. If you hire an attorney and he or she tells you that filing a lawsuit is in your best interest, it is wise to take the advice seriously. The reason is because you can obtain money for future problems that might arise from your accident injuries. An attorney has helped numerous clients in your same position and knows when a settlement should be refused.
